Links Online Solutions (G. L. O. Solutions) provides web hosting to a large number of clients. We
have a responsibility to protect each client and provide the best services
available. The following guidelines have been established by our friends
at the lawyers office to ensure that our promise to our clients is
perpetuated.
Our Policy:
All services may be used for lawful purposes
only. Transmission, storage, or presentation of any information, data or
material in violation of any United States Federal, State, Canadian,
Provincial, or City laws are prohibited. This includes, but is not limited to, copyrighted material,
material we judge to be threatening, obscene, demeaning to others, or
material protected by trade secret and other statute. The subscriber
agrees to indemnify and hold us harmless from any claims resulting from
the use of the service which damages the subscriber or any other
party.
Traffic and Bandwidth Guidelines:
Each account comes with a
predefined free amount of data transfer per month. We review bandwidth
usage daily, and if we see a pattern of high bandwidth utilization forming
we will either contact you via email or telephone call. We reserve the
right to disable a site that is violating account allowance bandwidth
usage. Additional transfer fees apply for data transfer amounts over the
predefined limit on that account.
All sites hosted by
G. L. O. Solutions have the privilege of unthrottled
traffic. This means your site is connected to multiple backbones which
allow a user to surf your site at unrestricted speeds. If they surf your
site using a 56k modem or a 45mbps DS-3, you are not penalized for the
high bandwidth web surfer that creates high traffic spikes. In other
words, you are responsible for data transfer amount, not data transfer
rates.
High Resource Guidelines:
CGI scripts, Perl scripts, CRON
jobs, etc. are allowed provided that they utilize a "normal" amount of
server resources. High Resource sites are sites that use an excessive
amount of system resources such as high bandwidth, high storage, high disk
utilization or high CPU utilization. Any site that is deemed "High
Resource" by
G.
L. O. Solutions
for any, some or all of the preceding reasons
will be entered into our "High Resource Client" program. It is at
G.
L. O. Solutions' sole discretion to determine which sites are "High Resource"
sites. A site which has been deemed a "High Resource" site will be subject
to the following:
- Verbal or email warning;
- Deactivation of
account if action is not taken in a reasonable amount of time;

Additional charges for usage of a particular resource over the set amount
allowed per account.
We do not allow clients to install their own
chat rooms that are CGI based, as these tend to be demanding of the
system. However, clients are allowed to have Java-based chat rooms.
Background running programs or programs to run continually in the
background are considered on a case-by-case basis and an extra charge will
be incurred based on system resources used and operational maintenance
needed.
Due to their use of flat files instead of databases,
G.
L. O. Solutions cannot allow the use of UBB or YABB bulletin boards. Use of these
boards for large or very active forums results in degradation of server
performance, and cannot be allowed in our shared server environment. G.
L. O. Solutions suggests using VBulletin or phpBB as a more efficient,
database-driven alternative to these bulletin boards.
The High Resource Guidelines also apply to any operation that cause
strain to servers on other sites.
Content Guidelines:
Pornography and sex-related merchandising
are prohibited on all servers. This includes sites that may infer sexual
content, or link to adult content elsewhere. This is also true for sites
that promote any illegal activity or content that may be damaging to our
servers or any other server on the Internet. Links to such materials are
also prohibited. Pornography that we prohibit includes nudity and nude
sexually explicit anime. Partial nudity as art is considered acceptable.

O. Solutions
Use Policy.
Examples of unacceptable content or links would be:
- Pornographic
content;
- Pirated software, hacker programs or archives, "wares",
shareware or freeware;
- Copyrighted material to which the site owner
does not own the copyright (such as audio, video, image and multimedia
archives). You are allowed to post on your site MP3's to which you own the
copyright. However, we do not allow copyrighted MP3 music for download or
archive;
- Distribution points, or any site whose primary purpose is
file distribution (Downloadable copyrighted software is prohibited on the
servers. Sites that specialize in the distribution of images, software,
and software add-ons are not allowed);
- IRC Bots;
- Sub-hosting (any
domain housing additional users without first clearing it with G. L.
O.
Solutions).
We will be the sole arbiter as to what constitutes a violation of this
provision.
Server Abuse:
Any attempts to undermine or cause harm to
("hack") a server is strictly prohibited. If you use, or attempt to use
the servers for purposes other than that of which they are intended,
including but not limited to tampering, hacking, modifying or otherwise
corrupting the security or functionality of the servers, your account will
be terminated and you will be subject to damages and other penalties,
including criminal prosecution where available.
Commercial Advertising & Email Guidelines:
Our servers
may not be used as the source, intermediary, or destination address
involved in the transmission of spam, flames, or mail bombs. Client
domains may not be referenced as originator, intermediary, or reply-to
address in any of the above. Spam is defined as any mass unsolicited
message in the mediums of newsgroups and email. As such, any violation
will result in immediate deactivation of services without refund.
Additionally, claims regarding Spam on any of our servers from our
customers or another providers which are investigated by G. L.
O.
Solutions will be billed for such work. Fees for such an instance, if you are found
to be at fault, is $0.50 per email sent and up to $500.00 per incident.
Advertising sites on other servers which in turn contain links to a
domain on our servers is prohibited.
We reserve the right to refuse or cancel service to known spammers. We
reserve the right to determine what violates this policy.
Payments
& Cancellation Guidelines:
Every thirty (30) days G.
L. O. Solutions shall debit Client's credit card. 2Checkout.com
is the authorized billing agent for G. L.
O. Solutions
services, and Clients will be billed by 2Checkout.com
G. L.
O.
Solutions shall be entitled to immediately terminate this Agreement for Client's
failure to make timely payments to PaySystems.com. Certain services carry
a set-up fee charged by G. L.
O. Solutions
to Client that must be paid by
Client in order to have use of the Services. If Client terminates this
Agreement, Client shall be responsible for any outstanding fees owed to G.
L. O. Solutions and agrees to pay any and all fees incurred by Client.
Because the Services are provided on a monthly basis, Client will be
responsible for Service fees incurred each month regardless of when Client
provides notice of termination. Thus, for example, if Client provides
notice to terminate on the 15th of a particular month, Client will still
owe fees for the entire month and such fees will not be pro-rated or
refunded. If Client has retained the Services for one (1) year and has
pre-paid G. L. O. Solutions
for such Services, refunds will be issued for any
unused full month portions of the Services upon Clients request.
Therefore, if Client's account is cancelled at any point during the one
(1) year term, Client will be entitled to a refund for the months
remaining after notice given by the bill date of the next month.
Credit card orders will be set up within 12 hours, provided that the
credit card is approved for the transaction. All credit card payments will
be billed on the date due. Email notification will be sent only if
requested at the time of renewal, and is only a courtesy email and not an
invoice. In the event the credit card is declined for any reason, the
client will be notified by email. Past due accounts that are not brought
current within 5 business days of the email notice are subject to
suspension and possible account termination. Charge-backs or denying credit
card charges will be subjected to the amount owed on current and past
unpaid invoices in addition to a chargeback request fee of $25.00. Any
past due account is subject to suspension and/or termination, and
collection by an outside agency for recovery.
All payments must be in U.S. currency. If you require special

Refusal of Service:
G. L. O. Solutions reserves the right to
cancel service at any time. All fees paid in advance of cancellation will
be prorated and returned to the customer if G. L.
O. Solutions
acts upon it's
right of refusal. If account termination is caused by a client's violation
of these policies, then no refund will be disbursed.
Disclaimer:
G. L. O. Solutions
makes no warranties of any kind,
expressed or implied for services we provide.
G. L. O. Solutions
will not be
responsible for any damages you or your business may suffer.
G. L. O. Solutions
disclaims any warranty or merchantability or fitness for
particular purpose. This includes loss of data resulting from delays,
non deliveries, incorrect delivery, and any and all service interruptions
caused by G. L. O. Solutions
and its employees.
Indemnification:
Customer agrees that it shall defend,
indemnify, save and hold harmless G. L.
O. Solutions
from any and all demands,
liabilities, losses, costs and claims, including reasonable attorney's
fees asserted against G. L. O. Solutions,
it's agents, it's customers,
officers and employees, that may arise or result from any service provided
or performed or agreed to be performed or any product sold by customer,
it's agents, employees or assigns. Customer agrees to defend, indemnify
and hold harmless G. L. O. Solutions
against liabilities arising out of; (1)
any injury to person or property caused by any products sold or otherwise
distributed in connection with a G. L.
O. Solutions'
server; (2) any material
supplied by customer infringing or allegedly infringing on the proprietary
rights of a third party and (3) copyright infringement.
G. L. O. Solutions reserves the right to revise its policies at any time
without prior notification. The current policies apply to all clients
regardless of the policies that may have been in effect at the time of
signup. |
